yeah i think im going to try and get the fine lowered and with no points we will see how it goes, who knows maybe one of the officers wont show up :D

Right now I am pending for a 86 in a 55, a state trooper up in upstate new york pulled me over, 31mph over is going to be 8 points in NY state, I already have a court date set for June 20th. Does anyone know if the officer doesnt show up, then the case is dismissed in NY state?

You live in Texas so what is the problem..........we have deferred adjudication. How this works...........you arrive on your specified court date, judge explains all the rules, you plead no contest request deferred adjudication. You will pay court costs and sign papers stating that you understand you are not to get another moving violation in any state for 90 days. They will give you another court date (90 days later). At the second court date, you will sign an afadavit that you have not received any moving violations in any state during your previous 90 days and again pay a fine and court costs. There will be no record as long as you did not receive a ticket during your 90 days. The beauty of living of Texas is that you can get a ticket every 90 days......................

Forget all these worries and know your state laws regarding tickets........in Houston the judge will tell you if you're planning on getting out of the ticket if your police officer does not show up, she/he will tell you we'll schedule a date when your policeman will show up and then you can show up again..........

yeah i kinda wanta get out of paying and get no points thats why i wanted to go to court but if you dont think i can then it wont be worth my time ill just go with drivers ed/differed

If you have a trial date and the officer doesn't show up, the ticket should be dismissed, especially if the troopers prosecute in the town in which you were speeding. If there is a prosecutor, the judge may, but not always, adjourn the case; but usually the ticket is dismissed.

What town was the ticket issued in? 31 mph over is a big ticket in NY. Do you have any points now or existing moving violations on your record (w/in the last 3 years). I am an attorney in upstate NY.

In the past I have successfully used the delay tactic many times. I usually ask for 2 adjournments and by that time the officer's schedule usually doesn't coincide with the courts, but not always.

I say can i see the radar read out, he says no some one was radaring from a bridge way back there. Hi I am a criminal attorney in California. Both officers need to show up. What you should do is contact the supoena division of the police agency and see when they have scheduled vacation or mandatory training-just tell the person you want to supoena the officers and want to know their schedule. If they have any vacation/training posted then set your trial then for then. I do not know about your state however here they do not need to show you the radar. Good Luck.

I worked in law enforcement for 22 years before going back to school and getting a degree in law, no police agency is going to release an officers vacation/training schedule to a civilian.

Wow, that surprises me. The agency I worked for would not release any personal information to anyone outside the legal profession, and than they required a written request.
