X5 is dead

My X5 has been at Stevens Creek BMW since December 28th and it is not functioning. They tell me it is a software problem. I cannot get anyone to help me out. The dealer I purchased from says that steven creek bmw should be helping me... BMW customer service will not return my calls and simply avoids the situation.

I have a 65,000 dollar car sitting at the dealer with know idea of when it will be fixed.

Does anyone know what I should do next?

Send a letter to the general manager and try BMW Germany. I'd suggest just filing a lawsuit with a lemon law attorney though. You can send a letter yourself first to see if you get a response but I'd just get an attorney to do it. Most are on contingency basis anyways and I think the CA Lemon Law says the manufacturer pays the attorneys fees if you win.
