speedometer fluctuation

Hi, I have a question on speedometer fluctuation. I've noticed cars behind me driving right on my bumper when I'm doing the speed limit, so I thought that maybe the speedometer was off. Today, I had someone follow me keeping the same distance between cars. I know that this isn't a scientific way to do it, but better than being pulled over by a cop! When my speedometer read 40 mph, the car behind me was at 35 mph. When I went up to 45 mph, they were at 40, but eventually both cars were at 45 mph. Does anyone else have this problem? Also, is there a way that the dealer would be able to check this out, and would it be covered under the "certified warranty"? Any insight would be appreciated.

Usually, speedos are calibrated to read a little high - that's usually intentional on the part of the manufacturer. Over Christmas, my fiancee and I went on a road trip in her dad's Subaru Legacy Outback, and her dad's PDA GPS navigation system consistently said we were going about 5 mph slower than the speedo said.

I don't think it's on purpose, but errors in speedometer settings, tire pressure, etc. On my e34, through the OBC, you can correct the speedometer. 5mph seems to be off by an awful lot, I've checked my e30 extensively against at least 6 cars, both of my parents cars, my friends stealth rt/tt, roommate's lumina, friends honda del sol, and a 330Ci, and have checked the e34 against my friends e36, and they were all the same. I can't imagine they'd purposely put it off that much with the intent to do so?
