Speeding Ticket -- Wrongfully Accused !!

Hey,

So this afternoon I picked my friend up from Manhattan College and went downtown (NYC) to pickup some stuff. I took the Henry Hudson Parkway (North) to get to his college, and on the way there, it is a 35 zone, but it is like 3 lanes and everybody likes to go mad fast. So I am heading there and all of a sudden a cop car over on the side turns on his lights and pulls over this van in front of me...but my radar didn't make a peep at all, so I thought, "That was weird." So I pickup my friend and we hung out in the village, and then we were on the way back, in my car, on the Henry Hudson Parkway (North). We are coming around the corner and I remembered the cop, so I hit my brakes and I am chilling at moderate speeds with traffic (around 45-50, I was only in 3rd gear). I see the cop up ahead over on the side...as I am approaching the cop car, the cop PUNCHES it and gets in front of me and turns on his lights and crap, and I'm like, "I wonder who he's gonna pull over." Then all of a sudden, he gets on my left side and then gets behind me and says "INFINITI PULL OVER" through his gay speaker or whatever. So I pull over and the cop is like all heated and he goes, "I got you on laser going 62 in a 35 zone, give me your driver's license." And I was like, "WHAT!! I defintely WASN'T going that fast, I was just going with traffic!" And then he counters with, "Well I got you on laser going 62mph" and I argued saying something else and then I finally handed him my driver's license and my PBA card. He immediately handed my PBA card to me because he said I'm getting a summons. So he comes back and hands me the ticket and my driver's license and I say, "If you laser-ed me, howcome my radar detector didn't make a peep?" And then he starts talking about how radar/laser detectors are all crap products and that it doesn't matter because he can estimate my speed with his eyes. Then I ask him to show me the printout of my speed from the laser and then he gets really shady and goes, "I estimated your speed with my eyes...that's all I need to give you this ticket, I don't have to show you the printout blah blah blah" and he was super pissed because I was calling him out on the laser. But the thing is, there was no way he could have estimated my speed because I was flowing with traffic, it was a whole pack of cars, it was night time, and I didn't even go BY him...I was just approaching him and he freaking cut me off....how could he estimate my speed when blinded by headlights and the night, while trying to merge onto the highway to cut me off and pull me over?? I think the cop was full of shit and just wanted to pull my ass over just to give me a ticket, thinking I wouldn't fight it. Well, I definitely am fighting it...how should I go about this? I am so frustrated at this whole thing, I cannot believe a cop would be SO full of shit....

That is a one of those cops you know.[}:)] A$$holes. I had this same thing but I didn't fight it because I know I was going fast. I got pulled over for doing 65 in 35 are. I had to go to the court because my speeding exceeded 25mph. Than I went to traffic school because this was my first ticket ever. So it cost me $350 for the ticket including traffic school fee and than I had to pay $30 to the traffic school instructor. Very bad. I learned.

But your case is different. Go fight it.[rofl]

That sux. I know in MA, the ticket is checked whether he used radar, laser, or estimated. Sadly though, if you can prove the time, that you were within traffic, and he only checked the "estimated" box, then you should def fight it. If however he did check laser, you should request all details regarding your speeding ticket along with all evidence they have against you.
You can request that for free from the state before your hearing, and it will show exactly what the officer wrote down on your ticket as evidence. At least it gives you a stronger case..

Plus just mention he was going all crazy saying his eyes are so accurate that they are like a laser gun (meaning he can place your speed within a 1/10th of a mph). hehe

Last time I was in New York I saw a cop having a tow truck pull a Mercedes from a parking spot (expired meter), the cop deliberately told him to (because there was nothing to attach onto the car to tow it) rip the front grill off just to tow it.

Go to court and get a good lawyer. My friend got a speeding ticket going 26 mph over. The lawyer was able to get the points on the license down to 3, which is the minimum for a speeding ticket.

I have had many tickets, I mean many tickets and each time I paid the fine or took defensive driving when allowed because I knew I was guilty. But, one day I got a ticket and was shocked, was even following behind a police car......that ticket I requested a jury trial............and WON!!!! You have the right to a jury trial, hire you a lawyer.........dont let the judge decide because they will never let you be innocent.........it can be done..........just time and money.......

Elussive: i know you have the money for the ticket and the trial, but if you are 100% truthful in your original post, I'd like to see you go to a trial and not be charged with a lie.

My advice to you when it comes to the NYPD is to drive the speed limit, if not slower when u spot that crown victoria or impala 1/2 a mile away, logically I wouldn't fight a NYC speeding ticket and expect to win, btw since you're in NJ what happens if you ignore it? State or Federal jurisdiction?? (confess ignorance)

I am being completely truthful, but there are always two sides to a story, and you're only hearing mine. I am open to the fact that I might have been going 62mph, but I highly doubt it...I was keeping up with traffic, no faster than that...some cars passed me on my left. My only fear is that the cop really did laser my ass and my radar just didn't pick it up...but I'm willing to bet that he didn't laser me at all since he shifted his story as soon as I called him out on the laser, and requested the printout.
The ticket is a 6-point ticket...even though it's an out-of-state ticket, DMV's are networked so it will show up on my license and I probably will get the points for it if I don't fight it. I contacted a law firm already, I am waiting to hear from them. I have confidence in myself and my case, but I want a professional on my side. The cop was a real jerk and I think he was full of shit, so I'm going to prove that.

Goodluck, if it's 6 pts you might as well fight it, especially under the circumstances... All I know is NYC speeding tickets are tough.

Because the judges here are a-holes, and if it was in Manhatten they will side with the officer especially with the mayors policy, infact he believes that one shouldn't bring their car into the city and if they do and they violate the law they should be ticketed. And with the budget problems...... but now that I think of it, if you were following traffic doing 45-50 and he did an eye estimate there might be a fighting chance. I will say that I never heard of a cop bsing on a speeding ticket, and from my experience with judges I doubt they'll buy it.

Either way I wouldn't worry too much, at least you have a case... imagine if it was 68 in the left lane in a 50mph zone, clear shot. Theres no appeal there.

Make sure to state that you were within traffic and there were vehicles passing you on your left. This shows that you were not the only vehicle on the road nor were you the fastest. He might have hit another car that was passing you and “thought” it was you. Word of advice, don’t go with attitude, you will be in their environment and confrontation will only hurt. If you state your case calmly and say that you don’t understand how the officer could have singled you out from traffic, especially if cars were passing you on your left I think you have a good shot. (IMO leave the laser detector out, it will only show that you are a speeder)Good Luck.

Dunno about laser, but Lidar (sort of a cross btw laser and radar I think) has a little cross hair thingy and a beam that's 3 feet by 3 feet, so if you get hit with that sucker, it's you.
