Was driving along to a friend house at 25mph, hit a huge dip, nail a manhole cover. Biggest bang ever.






Im sure having 3 passengers in the car didnt help either. Some one took a huge shit on my luck for the past 4 months. All of this is honestly just killing me inside. Im going to have the town reinburse me for the damage, if not, lawsuit, because I seriously barely can afford to keep my ride in good shape, last thing i need is for this to come out of my own pocket.

Wow, how high above the road surface is that cover? It will help your case, assuming it is excessively high, photographing it with a reference item next to it, say a cell phone, cigarette pack, ruler, etc.

Its not that it was excessively high, its just the huge dip right before it caused the suspension to compress on the way down, and hit the much higher manhole cover on the way up, had four people in the car. SUVs going through the same road take it at 2-5mph, first time I drove through that street, I dodged the first dip and ran right into the second..

Wow that sucks. Any of you legal guys know if a municipality can be held liable for damages like this? I thought they were pretty much immune from legal claims/lawsuits unless you can prove intentional negligence of an official?

Each municipality has a different way of dealing with it, but most of them make you jump through ridiculous hoops.

GENERALLY SPEAKING, in order to succeed in a claim, you would have to show that the municipality knew of the danger and chose to do nothing about it; i.e. that the municipality's conduct amounts to gross negligence. Kind of difficult to prove and probaly not worth it.

However, each jurisdiction will be different. Look up the governmental immunity laws for your municipality and it will tell you what you need to do to succeed with a claim.

Around here, people file all the time for damage from potholes, etc. Some are successful. This one will be a little harder cuz it's less obvious. But yeah, there are still a lotta hoops they make you jump through. I'd definitely send something in writing right away, just so they can't argue that you got the damage later.

This is very obvious, you guys should see this street during daylight, looks like a war zone. I didnt see till last second at which point it was too late. Im filing a claim with the city, apperantly im not the only one to get damage on that street, I talked to one of the residents who said that his rim was damaged on the same dip, and the city reinbursed him for the damages, hoping the same will go for me. Had to push the car over a mile and a half to a audi/ vw tuner that will take care of the damages.
