Need opinion, is BMW screwing me?!

I could use everyones advice on this. My 2000 323 Ci has developed a hairline crack on the transmission. (manual). Dealer AND BMW N/A is saying that , well, too bad. Get it fixed.

I took the car to some local German car experts and they were of the opposite view of "Wow, never saw that before, its a casting error on BMW's part, No car should ever get that out of the blue."

Other enthusiasts have also said that its a manufacturing problem. What do you guys think? And any advice? BMW N/A is treating my quite rude, saying its my problem, not giving me anyone else to talk to, or even allowing me to get my mechanics to talk to anyone else at BMW.

Did anyone ever do any work to the car that required disconnecting the transmission from the engine?

I have seen this at work a few times and filed a few claims because employees try to pry them apart and crack the transmission case.
