A U-S District Court in Cedar Rapids has found the design of a B-M-W is not responsible for injuries a man suffered in a rollover crash.
Thirty-five-year old Marc Brey of Omaha, Nebraska was traveling east on Interstate 80 near Williamsburg, Iowa, in July 1999 when he lost control of his 1998 B-M-W M-3 in a rainstorm. His car collided with a westbound vehicle.
Court records say Brey's neck was broken and he still requires round-the-clock assistance.
He was seeking 28 (m) million dollars from B-M-W of North America. He says the design of the roof caused more serious injuries.
An attorney for the car maker says the roof supports did not cave in until after the two vehicle collided, and by that time Brey's neck was already broken.
