I'm am not at all knowledgeable about class actions suits, but to me this seems rather silly. This is the first that I have heard of this "problem". If it was worthy of a class action lawsuit, wouldn't it be more widely know, at least in BMW forums? I don't have the NAV system, and I have noticed that compared to other FM car radios I have, the HK definitely has a weak front end (the part of the radio that receives and amplifies the RF signal). But since BMW doesn't advertise receiver sensitivity specs, what standard can they be held liable to?

I'm not bashing class action suits, they have their place, but class action suits of this level make money for the attorneys and no one else.

As far as the SLIPTronic issue, BMW is taking full responsibilty for the problem. What is the purpose of even suggesting a class action suit at this point? [???1]

I think that person needs to stop being a baby and let go of the matter. Just get rid of the car if it bothers you that much. The cost of hiring a lawyer, filing the lawsuit and winning it is probably worth more than a new BMW. I understand that when you dish out that kind of money for a BMW that it shouldn't have a problem that is non-fixable but shit happens. This guy must love the car to death if he is keeping it but still suing BMW. Sometimes people cut their nose, despite their face....wake up![thumb]

[duh] Not to mention, the cost of defending corportate litigation is passed on to the consumer. Does he really think it's BMW he would be hurting? If their cost of defending lawsuits goes up say 10% per year, then they'll pass that on in the price of the car, maybe a couple percent per year.

I don't know about you guys but I got a letter in the mail from BMW today saying that they are aware the climate control in the e46 was programmed wrong and that if you leave the car off for a few days in cold weather it might not start. If you go to the dealership they fix it for free, it takes an hour.

Maybe BMW is still investigating the radio issue (I don't have HK, haven't experienced it) and will send one of these letters out to people soon.

Ok that guy who posted that has a "legitimate" beef with BMW. He never said he didnt like BMW's or wanted money. He said that they blew him off. As BMW lovers we all would feel affronted if we were blown off by the car manufacturer too. So he decided to bring a lawsuit against them. Perfectly within his rights as a consumer. If it is broke then BMW or whoever needs to fix it. Damn stereo costs a pretty penny anyway.....

My opinion is he has reason to sue. His follow-up post to all the critics and sarcasm, explains it all. If everybody just lets things like this be, coz' it's too expensive or too much of a hassle, there will be nothing to stop or discourage big corporations from taking advantage of us consumers. Sometimes it's not a matter of money. It's about integrity and justice.

As an example, I am currently trying to resolve an issue with the person I bought my car from 8 months ago. Long story short, still trying to get the CD changer and phone which was supposed to be included in the sale. If it doesn't work out with the Better Business Bureau with whom I just recently filed a complaint, I plan to get a lawyer and get this @sshole to court. I know legal fees will end up costing more than the CD changer and phone, but hey, he needs to know he shouldn't have messed with me! And he needs to be taught a lesson not to pull that trick again on his next victim!

I wonder if that dude went back and actually re-seated all the antenna cables. I had a 02 325xiT with Nav and HK sound and yes, the HK-enhanced sound would fringe in and out. If it bugged me too much I just cut out the enhancement......

If I wanted audiophile sound performance I'd stay home [:)] , or put in a more sensitive tuner.

BMW doesn't quote radio sensitivity numbers, so I don't know how you can have a Lemon Law or false advertising issue.

- Engine should be more powerful
- I'm 6' - 3" and the back seat legroom in my 330cic makes my legs cramp up
- False Advertising - When compared to a Ferrari, BMW is not "The Ultimate Driving Machine"

I think we should argue that there are cars that are "More ultimate" so how can BMW be "THE" ultimate. [fake]
