Got official word on my accident

My mom picked up the police report, and not only am I not at fault, but the guy in the audi got a moving violation for making an unsafe left turn!! The witness testified in my favor and said I was passing him slowly.

sux to be that guy. thats good news for you!

Out of curiosity, why did it take so long to get the report. When a drunk lady destroyed my parked bimmer on a friday night i had the police report in my hands the following monday.

Congrats!

Sometimes it just takes a while to get a police report. Cop might be busy or not want to do it so it lust kinda lingers for a while. Other times, they may actually be trying to track down a witness for a statement or other investigative stuff.

Okay so the good mood lasted for 5 minutes. I got a call from my dad and he said insurance is only paying ****ing $2900 I'm so unbelieveably pissed off right now. that's not even the average RETAIL for my car!!!!!!!!!!!!!!!!!!!!!!!!!! If i sold the car I would get at LEAST $3500!!!!!!!!! I'm so pissed off, can't even talk on the phone to people. I don't understand why my insurance is paying me for the car, shouldn't his insurance?!?! What the **** is going on?

You need to get your parents to call and negotiate with the Ins. Co. Educate your parents on the value of the car...print them out Blue Book values, show them ads in the newspaper, Ebay auctions, Auto Trader etc... Show them that what the Ins. Co. is paying is under value.

You CAN negotiate with the Ins. Co.. After our X5 4.4i was totaled the Ins. Co wanted to pay $51,000 for our car. We provided proof of all the options, the mileage of course, etc, etc... We got them to up it to $58,000.

Thankyou for the advice!! I appreciate it. My dad doesn't want me to buy the car back, but there are still a lot of very good parts in that thing - I could easily get $2000 parting it out.

You can negotiate how much they give you. I did it with my fiancee's Jeep, although the Ins. Co. wasn't too happy about it. We got fair market value for the vehicle. If they're lowballing you, then fight it. However, realize that your car may not be worth as much as you think that it might be. Check fair market value through the methods listed above. www.kbb.com is a good resource.

Also, we got money for a rental car, although it was only about $30 per day. Altogether it turned out pretty well for us. To "replace" the Jeep, we purchaced an e36 325i.

Trust me, the car is definitely worth more than $2900!!! It was in better condition (by FAR), especially at the time of the accident, than other E30's with more miles than my car, that go for $4000+. I'm getting lowballed.

kbb Private party value for an '88 325is in Pittsburgh with 100k miles on it in is $3k. Retail for the same thing is $4.2k. These are both assuming the car is in near-perfect condition.

I'm guessing that your car has more than 100k on it, but more miles doesn't significantly change the value of these year BMW's.

I'm guessing that they won't move too much on the price of this. Ask, though, and you may get $3.2k or $3.3k out of it. If you're concerned about mods that you have on the car, buy it back, and sell them off. When your parents get tired of seeing the shell hanging around your lawn, send it off to be crushed. I'm sure that you'd find a long line of people waiting for parts on these forums and others, though, so do the community (and your pocketbook) a favor and buy it back. =)

I hope that you can get more off of the insurance co, though. If cars locally are going for $4k, then that's evidence to your favor to get more. Best of luck, for sure!

Kelly blue book is always a little low - if you go by nada (www.nada.com) it is more accurate. It's not the kelly blue book that should change it, the fact that I see these 87 - 89 325is's with more miles, or in worse condition, go for $3500+, is what bothers me.

next time you call the insurance guy, have your parents next to you, and explain the situation, in my case, i just tell them that my parents don't speak english, so i have to do it on their behalf [:D] (of course when i hand the phone to pops, he rambles on trying to find out what's going on.. then once he realizes he doesn't understand wth going on, he hands me back the phone.. soooo annoying.)

ANYWAY, have your parents authorize you to talk to the adjuster, then you should be able to negotiate with those idiots. just have your parents tell them that you know the situation better than he/she does, and that they would feel more comfortable if you settled it with them, rather than him/her self.

edit: congrats, and boooooo for the insurance part..

here's a tid bit of advice...at the advising of a lawyer I did this with my accident and it turned out prettty well. Ask them to round it up slightly 100 buck or something, then ask them for $$ for a rental car for the average time it takes to find a new car, since you're legally not allowed to rent a car, impress upon the insurance company how much of an inconvenience it is and use a little pity and even mention how your ankle was hurting and lay it on thick--I mean thick. If the person ur talking to is female (I don't mean to start anything) you'll probably get some extra $$. I got close to 1k for a rental car with my accident doing this. It's worth a shot. And just by the fact it's state farm, don't hold your breath on recieving more for the actual value of the car. Also, all the parts you recently put in the car (I think you replaced the clutch recently and some other stuff, show them the reciepts for that and they MUST refund you for that if the parts were installed within the last 3 or six months (at least in MD).

Good luck man, and glad to hear that dude got a moving violation and you were not held liable.
