Brand New X5 does not work

My X5 has been at Stevens Creek BMW since December 28th and it is not functioning. They tell me it is a software problem. I cannot get anyone to help me out. The dealer I purchased from says that steven creek bmw should be helping me... BMW customer service will not return my calls and simply avoids the situation.

I have a 65,000 dollar car sitting at the dealer with know idea of when it will be fixed.

Does anyone know what I should do next?

Start calling the mangers and owners of the facility where the car is, I would plant myslef there as well until you get some action.

How long has it been sitting there? If it's been like a month, you can start contacting a lawyer for lemon law, and you should be provided with a nice loaner in the mean-time.

I thought there was a law that says that if the vehicle has major problems right away then the dealar must offer to buy back the car. It is not the lemon law as that has to do with cars that have reoccuring problmes.

Find out for sure and dont ask them to buy back the car, go over there and force them to. Dont let them try to wait a few weeks, not even a few days. Make them do it then and there, dont take crap from them. If they still give you trouble then protest in front of their building, it will scare away potential customers and force them to take action.

After thats all done go to another dealar and purchase the BMW there becuase you dont want to work with a dealar that is giving you trouble.
